Why is this happening?
Our request for a building permit for our existing building requires some minor upgrades to meet the latest WUI (Wildlife Urban Interface) building code specifications. We have submitted plans to the city to make these changes, but we are not allowed to make them until we get the building permit. Catch-22 - we are not allowed to bring the deck into building code requirements during the current review process. We applied for this permit in August of 2020.
The building is safe. No one is in danger while in our building because exit is quick and easy. However, the code is the code, and it is being strictly enforced.
Additionally, a certified fire sprinkler company installed the fire sprinkler system in our building, and it was later inspected by an independent Pipefitters Union inspector. However, Santa Clara County Fire requires that they inspect it, and they will not inspect it until it has a building permit. Another Catch-22.
We are currently working to resolve these issues with the city and with SCC Fire, and plan to reopen the building once an agreement is reached.
